01What these terms cover
These terms are the agreement between you and Masar Software Solutions ("Masar", "we") for the products we operate ourselves: Watin, the Quran circles platform, and Maraa, the farm management platform — together with any other product we launch under our own name, and their websites, mobile apps, and APIs.
They do not cover custom software we build for a client under a signed proposal — that work is governed by our Terms & Conditions. If you are unsure which applies to you: if you signed a proposal with us, it is the Terms & Conditions; if you created an account in one of our products, it is this document.
By creating an account or using a product, you accept these terms. If you are accepting on behalf of an organization — a school, a Quran circle, a farm, a company — you confirm you are authorised to bind it, and "you" means that organization.
02Who can use the products
Our products are built for organizations and the people who run them. To hold an account you must be at least 18 years old and legally able to enter a contract.
A product may hold records about people who are not account holders — students in a Quran circle, for instance, some of whom are children. Those records are entered and controlled by your organization, not by us, and the responsibilities in "Data you put into the product" below apply to them.
03Your account
Give accurate registration details and keep them current. You are responsible for everything done under your account, and for keeping credentials private — including the accounts you create for your teachers, supervisors, staff, or workers.
Do not share one login between several people; create a user for each person instead. Tell us at info@masarsoftware.com as soon as you suspect an account has been compromised.
04Subscriptions and billing
Products are offered on subscription plans, and some offer a free tier or a trial. Prices are in Saudi Riyals (SAR) and exclusive of VAT unless stated otherwise; VAT is applied at the prevailing rate.
Subscriptions are billed in advance for the period you choose and renew automatically for the same period until you cancel. You can cancel renewal at any time from your account settings, or by writing to us; cancelling stops the next renewal and does not shorten the period you have already paid for.
We may change prices, but not in the middle of a period you have paid for — we will give at least 30 days’ notice before a change takes effect at your next renewal. If a payment fails we will retry and notify you; an account left unpaid may be suspended and, after a further 30 days, closed. Refunds are governed by our Refund Policy.
05How you may use the products
For as long as your subscription is active we grant you a limited, non-exclusive, non-transferable right to use the product for your own organization’s operations. You agree not to:
- Resell, sublicense, rent out, or white-label the product without our written agreement
- Copy, decompile, reverse-engineer, or try to derive the source code
- Bulk-extract data by scraping or automated means beyond the export tools and APIs we provide
- Probe, overload, or interfere with the service, or bypass its security and access limits
- Upload malware, or content that is unlawful, infringing, or offensive
- Use the product to break any law of the Kingdom of Saudi Arabia or of the country you operate in
06Data you put into the product
Your data stays yours. Students, attendance records, farm operations, resources, yields, reports — you own all of it. We claim no ownership, and we do not sell it or use it to advertise to anyone.
You grant us only the permission we need to run the service for you: to store, process, back up, and display that data, and to transmit it to the infrastructure providers the product runs on. Nothing wider.
When that data describes other people — students and their guardians, teachers, employees, workers — you are the data controller and we act as processor on your instructions. You are responsible for having a lawful basis to collect it, for telling those people how it will be used, and, where a student is a minor, for obtaining the consent of a parent or guardian as the Saudi Personal Data Protection Law requires. Our Privacy Policy explains how we handle it on your behalf.
07What belongs to us
The products themselves — software, source code, design, interfaces, names, and logos — belong to Masar and stay ours. A subscription buys access, not ownership, and nothing here transfers any intellectual property to you.
If you send us an idea or a feature request, thank you — we may build it, and you are not owed payment or credit for it. That does not give us any right to your data.
08Availability and changes
We work to keep the products available and fast, and we take backups — but we do not promise uninterrupted service. Maintenance, upgrades, and occasional outages happen; we will give notice of planned maintenance where we reasonably can.
Products evolve. We add features, change them, and sometimes retire one. If we remove a feature you rely on or discontinue a product entirely, we will give at least 60 days’ notice and a way to export your data.
09Support
Support is included with a paid subscription, by email at info@masarsoftware.com and on WhatsApp during Saudi business hours. We aim to answer within one business day. Support covers using the product and fixing faults in it; it does not cover building custom features for you — that is separate work under our Terms & Conditions.
10Third-party services
Our products run on services we do not control — cloud hosting, app stores, payment gateways, messaging and notification providers, maps. Their terms apply to their part, and we are not liable for their outages, policy changes, or decisions, including an app store removing or refusing an app.
11Suspension and termination
You can stop using a product and close your account at any time from your account settings or by writing to us.
We may suspend or close an account that goes unpaid, breaches these terms, or puts the service or other customers at risk. Except where the law or a serious security risk requires immediate action, we will warn you first and give you a reasonable chance to put it right.
12Getting your data back
You can export your data at any time while your account is active, using the export tools in the product. Ask us and we will help.
After an account closes we keep your data for 30 days so you can still retrieve it, then delete it from our live systems; backups age out on their normal cycle. If you want it deleted sooner, say so and we will. Records we are required to keep by Saudi tax and accounting law — invoices, for instance — are kept for the period the law sets.
13Warranties and disclaimers
We provide the products with reasonable skill and care, and we fix faults we are told about. Beyond that, the products are provided as they are: we do not warrant that they will be error-free, uninterrupted, or fit for a particular purpose you have in mind, and we do not guarantee any outcome you hope to achieve with them.
Keep your own copies of anything you cannot afford to lose. Our backups are a safety net for us, not a substitute for your own records.
14Limitation of liability
Our total liability to you for any claim connected with a product is capped at the subscription fees you paid us for that product in the 12 months before the claim arose.
We are not liable for indirect or consequential loss, or for lost profit, revenue, business, goodwill, or data. Nothing here limits liability that cannot be limited under Saudi law, including for fraud or gross negligence.
15Changes to these terms
We may update these terms as the products change. For a material change we will notify account holders by email or in the product at least 30 days before it takes effect. Continuing to use a product after that date means you accept the new terms; if you would rather not, you can close your account and we will refund the unused part of a prepaid period.
16Governing law
These terms are governed by the laws of the Kingdom of Saudi Arabia. Disputes we can't settle amicably within 30 days go to the competent courts of Riyadh.
